- Seller listings: equipment details, asking price, location, description, your name, company, email, and phone number, and a record that you accepted our commission terms, including the date and time.
Our hosting provider may also process basic technical data, such as IP address and browser type, to deliver the site and keep it secure.
How we use it
- To review your request or listing and follow up with you.
- To match buyers with sellers and make introductions.
- To send you a confirmation email and follow up on your request or listing.
- To keep records of listings, introductions, and commission terms.
- To run, secure, and improve the site.
Who we share it with
We do not sell your personal information. We share it only as needed:
- With the other party in a match. When we introduce a buyer and a seller, we may share the details needed to complete the introduction, such as name, company, contact information, and the equipment involved.
- With service providers who help us run the site, such as Cloudflare (hosting, database, analytics, and bot protection) and Resend (email delivery). They process data on our behalf.
- When required by law, or to protect our rights or the safety of others.
Cookies
Our site does not use advertising or tracking cookies. We use Cloudflare Web Analytics to understand site traffic in aggregate; it does not use cookies or track individuals across sites. Our forms may use Cloudflare Turnstile to detect automated bots, which processes limited browser information for that purpose. Our hosting provider may also use essential security or performance technologies.
How long we keep it
We keep requests and listings as long as needed for the purposes above, including to honor the protection period in any commission agreement, and as required by law. You can ask us to delete your information sooner.
Security
Information you submit is sent over an encrypted connection and stored with reputable providers. No system is completely secure, so we cannot guarantee absolute security.
Your choices
You can ask us to access, correct, or delete the information you submitted by emailing [email protected]. Depending on where you live, you may have additional rights under local law, and we will honor requests as the law requires.
Children
Our services are for businesses and adults. We do not knowingly collect information from anyone under 18.
Changes
We may update this policy. The effective date above shows when it last changed.
Terms of Use
By using rockoakequipment.com, you agree to these terms. If you do not agree, please do not use the site.
What we do
RockOak Equipment LLC, operating as RockOak Equipment USA, is an intermediary. We connect people who want to buy heavy equipment with people who want to sell it. We are not a party to any sale between a buyer and a seller, and we do not take ownership of, inspect, store, transport, or guarantee any equipment.
Requests and listings
- Submitting a request or listing does not create a sale or require either side to buy or sell.
- You agree that the information you submit is accurate and that you have the right to submit it. Sellers confirm they own the equipment or are authorized to sell it.
- We may decline, edit, or remove any request or listing at any time.
Commissions for sellers
Listing is free. If a seller sells equipment to a buyer introduced by RockOak, the seller agrees to pay the commission described in the commission terms shown with the seller form and in any signed agreement with RockOak. If the two conflict, the signed agreement controls.
No guarantees
We do not guarantee that any equipment will be sold or found, the price, the condition or title of any equipment, or the identity, creditworthiness, or conduct of any buyer or seller. You are responsible for your own due diligence, including inspecting equipment, verifying ownership and condition, and confirming payment and delivery terms before completing a transaction.
Acceptable use
You agree not to submit false or misleading information, interfere with the site's operation, attempt to access data you are not authorized to see, or use the site for anything unlawful. You also agree not to use buyer or seller contact details we provide to bypass our commission or for purposes other than the introduction.
Site content
The RockOak Equipment USA name, logo, and site content belong to us. You may not copy or reuse them without our written permission.
Disclaimer and limits of liability
The site and our services are provided "as is" and "as available," without warranties of any kind. To the fullest extent the law allows, RockOak Equipment USA is not liable for indirect, incidental, special, or consequential damages, or for any loss arising from a transaction between a buyer and a seller. Our total liability for any claim relating to the site is limited to the amount, if any, you paid us in the 12 months before the claim.
Governing law
These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules.
Changes
We may update these terms. Continued use of the site after a change means you accept the updated terms.
